Terms & Conditions of Hire

“Delivery Date” means the date on which the services shall be provided.

“Deposit means the monetary amount which must be provided prior to any provision of services by the Bell Tent Celebrations

“Equipment” means the equipment that is covered under the contract for hire.

“Client” is the individual(s) entering into contract with Bell Tent Celebrations.

“Price” is the price agreed for the provision of equipment by Bell Tent Celebrations.

“Site” is the site at which the equipment shall be provided to.

“Period of Hire” means the period from the Delivery Date until the Equipment has been dismantled and removed from the Site.

 

These conditions shall apply to all orders and contracts for the supply of Equipment in the UK by Bell Tent Celebrations.

 

1. Contract

 

Bell Tent Celebrations will submit a written quotation referencing the terms and conditions below which the hirer shall accept. The terms and conditions shall be accepted, thereby forming a contract.

 

Bookings are confirmed when a completed booking form has been received by Bell Tent Celebrations, along with the specified deposit amount or payment in full.

 

2. Conditions of hire

 

Bell Tent Celebrations' quotation for hire charges is made on the assumption that the site on which the equipment is to be erected or to which goods are to be delivered;

          • Has fairly flat grass with easy access for motor transport

          • Has natural grass i.e. not artificial

          • Is a clean area free from any animal excrement

          • Has no drain pipes, cables or other services buried beneath the surface or otherwise concealed.

The 4 metre Bell Tent requires approximately 5 metres of space to allow for ground ropes. It is the hirers responsibility to ensure there is adequate space when making the booking.

 

Should the site not comply with these requirements, Bell Tent Celebrations may in its discretion either rescind the contract by giving verbal or written notice to the hirer or make additional hire charges. Bell Tent Celebrations shall not be liable to the hirer for any loss damage or expense resulting from such rescission of the contract.

 

Bell Tent Celebrations only use battery operated or solar powered lighting. Any kind of heating, barbecues, fire pits etc. must not be used inside or near the Bell Tent.

 

3. Liability

 

Whether the site complies with the foregoing requirements listed in 2 above or not, Bell Tent Celebrations shall not be under any liability whatsoever to make good any damage to the site nor shall Bell Tent Celebrations be under any liability whatsoever in respect of damage to drains, pipes or cables or other services buried under the site or otherwise concealed or any consequential loss resulting from such damage unless an accurate plan showing the precise position of such drains, pipes or cables or other services shall have been supplied to Bell Tent Celebrations.

 

Bell Tent Celebrations shall not be held liable when the Bell Tent build is delayed or cancelled due to the site being inaccessible or ill prepared or in any instance where the site is deemed unsafe by Company representatives, where there is a delay or cancellation due to adverse weather conditions, where there is a delay or cancellation due to the hirer not obtaining appropriate permission from the public or local authority.

 

4. Positioning of services for hire

 

Bell Tent Celebrations may erect the Bell Tent and equipment where it considers fit, and after consultation with the hirer, and it shall be deemed to have performed the contract.

 

5. Payment

 

Bell Tent Celebrations reserves the right to charge a non-refundable £30 deposit and the balance will be payable 14 days before the date of event.

Bookings made within 14 days of the event must be paid in full at the time of booking.

Delivery and erection is included in the price.

 

A returnable security deposit of £100 is payable by cash or cheque on the day of the event.

 

6. Loss or damage

 

The hirer is wholly responsible for all equipment on hire from the time of delivery until collection. The hirer shall be responsible for the safe custody of Bell Tent Celebrations' property on the site, and will make good to Bell Tent Celebrations all loss or damage to Bell Tent Celebrations' property or equipment hired or used on the site (other than fair wear and tear) including breakages and damage and loss due to theft or burglary unless it can be proved that such loss or damage be caused by faulty material or workmanship or negligence on the part of Bell Tent Celebrations. We cannot accept any items in place of those supplied. Goods at all times remain the property of Bell Tent Celebrations.

 

A returnable security deposit of £100 is payable by cash or cheque on the day of the event. Any costs that are to be incurred by Bell Tent Celebrations due to damage, breakages or extra cleaning will be deducted from the security deposit and the balance will be returned to the hirer. If the security deposit does not cover the costs of loss or damage the hirer is responsible for paying all costs incurred by Bell Tent Celebrations.

 

7. Liability to third parties

 

Bell Tent Celebrations will not be responsible for and the hirer will indemnify Bell Tent Celebrations against all claims for injury to persons or loss of or damage to property howsoever caused unless it is proved that such injury or damage be caused by faulty material or workmanship or negligence on part of Bell Tent Celebrations.

 

8. Permits

 

The hirer is responsible for giving notice to or obtaining all necessary permits from any authorities who are or may be concerned and must make application where to the planning authority, district surveyor, police, fire brigade and any similar authority or organisation. Any cost as incurred in delays or modifications in the work arising from the absence of or misrepresentation of all such necessary permissions and permits shall be payable to Bell Tent Celebrations by the hirer and shall be deemed to be part of the hire charge for the purpose of clause 6 above.

 

9. Force Majeure

 

While every effort will be made by Bell Tent Celebrations to carry out any order accepted, the full performance of it is subject to variation or cancellation by Bell Tent Celebrations consequent upon act of god, war, strikes, riots, lock-outs or other labour disturbances, fire, flood, restrictions on the use of transport, fuel or power, requisitioning, shortage of material or transport or labour or any other cause beyond the control of Bell Tent Celebrations.

 

10. Cancellation or premature termination of contract

 

Notice of cancellation of the booking by the hirer must be provided to Bell Tent Celebrations in writing or by email.

 

Cancellation of 14 days or less of the event will result in 100% of the hire charge being forfeited.

 

Cancellation of more than 14 days prior to the event will result in the £30 deposit being forfeited.

 

11. Return of equipment

 

All equipment should be returned undamaged in a clean, dry condition.

 

12. Complaints

 

Complaints as to shortage or damage on receipt of goods should be made before use. Complaints of this nature received on return of goods cannot be entertained.
